San Diego could soon add a new incentive aimed at encouraging the construction of additional housing, which city officials say is the fastest and cheapest way to deal with the local housing crisis.
City officials are proposing to make it easier for developers and homeowners to take advantage of the city’s accessory bonus program, sometimes called granny flats, casitas or backyard units.

The program now allows premium ADUs to be purchased by all property owners who are willing to build an ADU and agree to rent it for 15 years at a low down payment to low- or moderate-income individuals.

The proposal would reduce the term of lease restrictions for low-income residents from 15 years to 10 years, but the city would retain the 15-year requirement for middle-income residents. Bonus ADUs can be rented at market rate.
The proposal, spearheaded by City Council President Sean Elo-Rivera, aims to encourage more property owners to create low-income ADUs.
San Diego’s rules for ADUs are already believed to be among the laxest in the state, but city officials continue to tinker with them.
Some of the changes are in response to complaints that the city’s lax regulations can ruin the look, feel and character of small family neighborhoods.

Last month, the city loosened the rules in part to improve the distances ADUs must build from property lines, improve landscaping requirements and provide more rule clarification.
The changes, approved by the City Council on Feb. 8, also reduced the potential impact of a state law that allows up to four homes on single-family lots. Property owners using the law — SB9 — are now barred from using any of the city’s ADU incentives.
According to the city’s ADU regulations, moderate income is defined as less than 110 percent of the area median income, which is $66,550 for a single-person family, $76,100 for a one-person family, and $85,600 for a two-person family. three and $95,100 for a family of four.
City officials are hoping that developers will be willing to give up thousands of rents for the first 10 years after ADUs are built in exchange for rent restrictions after 10 years instead of 15 years.

“Ten years goes by too fast, but I like the idea of allowing incentives to work and build more housing,” said Planning Commissioner Doug Austin. “Let’s face it, housing is not happening fast enough in San Diego.”
Since San Diego and the state began easing regulations nearly six years ago, ADU construction in the city has increased from nine units in 2016 to 386 units by 2020. The San Diego Housing Commission (), including its nonprofit subsidiary, Housing Development Partners. (HDP) has more than 4,100 rental apartments at affordable rents for low and moderate income residents.
Qualifying households with annual incomes that are no more than 80 percent of the San Diego Area Median Income (AMI) can rent at below-market rates.
Low-income seniors and people with disabilities can rent if their income does not exceed 80 percent of San Diego’s AMI.

A need-based program to assist families in affordable housing who have lost income due to covid-19, affecting their ability to pay rent.
Households who can demonstrate that they have lost wages as a direct result of the Covid-19 pandemic and are experiencing financial hardship as a result will be eligible for this program.
The program will help residents own or manage properties, including HDP. A searchable map of HDP properties can be found HERE. Federal Section 8 Housing Choice Voucher participants are not eligible for this program, but should contact their housing assistants for information about the low-income household rental assistance policy.
